Council position is vacant
Every week, I have watched the City Council meetings on Channel 21.
Dave Earling is the Mayor and he is charged with being “… the chief executive and administrative officer of the city. The Mayor shall see that all laws and ordinances are faithfully enforced …” RCW 35A.12.100.
Council Position #6 is vacant for nonattendance, “…a council position shall become vacant if the councilmember fails to attend three consecutive regular meetings of the council without being excused by the council.” RCW 35A.12.060.
The meeting minutes for Sept. 11, 18, and 25, 2012 have been approved by the City Council. The approved minutes for Sept. 11, 18, and 25, 2012 record Councilman Frank Yamamoto as absent.
A motion to excuse his absences from the Sept. 11, 18, and 25, 2012 Council Meetings was not made, nor were his absences excused by the majority of the Edmonds City Council.

It is the duty and responsibility of Mayor Earling to enforce the laws of the State of Washington. At the Oct. 5, 2012 Council Meeting he should have declared Council Position #6 to be vacant. The word shall is mandatory and not discretionary.
Dave Earling is not doing his job. He is not enforcing the laws of the State of Washington.
